These terms govern your use of this site. The parts that matter most are clause 3, which explains that nothing here is a diagnosis, and clause 5, which limits what you may use a result to decide.

Draft — not yet in force
This document still contains placeholders in square brackets for the operator's legal name, address and jurisdiction. It has not been reviewed by a lawyer. Fill those in and have it reviewed before relying on it.
MindHits is operated by [OPERATOR — registered legal name], [ADDRESS — registered address], [REGISTRATION — company / VAT number] (“we”, “us”). Contact: [EMAIL — contact address].
By using the site you accept these terms. If you do not accept them, stop using the site. If you are using it on behalf of an organisation, you confirm you are authorised to bind that organisation.
The site offers self-assessment questionnaires built from published instruments, scored in your browser against scoring keys that are printed on each test's page. Taking a test is free and requires no account. One optional extended report is sold for $19.
We publish each instrument's source, author and licence so you can check our work. We do not claim authorship of the instruments themselves, and we do not claim that our implementation has been separately validated.
Read this clause in full
Nothing on this site is a medical or psychological diagnosis, a clinical assessment, treatment, or professional advice of any kind. Using the site creates no clinician-patient, therapist-client or professional relationship between you and us.
Some instruments offered here, including the GAD-7 anxiety screen, the WHO-5 Well-Being Index and the Perceived Stress Scale, resemble tools used in clinical settings. In a clinical setting they are administered and interpreted by a qualified professional alongside other information. Here they are self-administered and self-interpreted, which is a materially different thing. A score is not a condition, and the absence of a score is not the absence of a condition.
Do not use a result here to start, stop or change any treatment or medication, and do not use it in place of seeking care. If you are concerned about your mental or physical health, speak to a qualified professional.
If you are in crisis
If you are thinking about harming yourself or someone else, do not rely on a questionnaire. Contact your local emergency number, or a crisis line in your country. In the EU you can reach emergency services on 112; the international directory at findahelpline.com lists lines by country.
Each test page states the known limitations of that instrument, and those statements form part of these terms. In general: self-report measures what you are willing and able to say about yourself; short scales are imprecise; scores are positions within a scale rather than percentiles against a representative norm group unless a page says otherwise; and results vary between sittings.
We take care that the scoring keys match their published sources, and automated tests check this, but we do not warrant that any result is accurate, complete or fit for any purpose of yours.
You agree not to use this site, or any result from it:
These restrictions exist because the instruments were not validated for those uses and because several of their licences forbid them. They apply whether or not you have paid for a report.
You agree not to:
You may take a test for yourself, keep your results, print them, and share a link to your own result with people you choose.
A share link encodes your answers in the address itself. Anyone with the link can see every answer you gave. Creating and distributing one is your decision and your responsibility; we cannot withdraw a link once you have sent it, and we have no copy to delete. The Privacy Policy explains the consequences in more detail.
The extended report costs $19 as a single payment. There is no subscription and no account. The sale is processed by Polar, which acts as merchant of record: your payment contract and your receipt are with Polar, and Polar is responsible for billing and for charging any applicable tax.
Delivery is immediate. After payment you are returned to a link that renders your report, and that link reopens it later. Keep it. We store no copy of your report, so if you lose both the link and your receipt we may be unable to restore access.
Right of withdrawal
Consumers in the EU and UK normally have 14 days to withdraw from a distance contract. For digital content delivered immediately, that right is lost once performance has begun with your prior express consent and your acknowledgement that you thereby lose it. We ask for that consent explicitly before sending you to checkout. If you do not give it, do not buy the report.
Regardless of the above, we will refund you where the report does not render, where it renders from an answer sheet that is not yours, or where it is materially not what this site described. Ask by replying to your Polar receipt or writing to [EMAIL — contact address]. Statutory rights that cannot be excluded are unaffected by this clause.
The site's design, code, illustrations, explanatory writing and report text are ours and are protected by copyright. Nothing in these terms transfers any of it to you. Buying a report buys you a personal licence to read, print and keep that report; it does not buy you the right to republish or resell it.
The assessment instruments themselves are not ours. Each is used under its own licence — public domain for the IPIP item pools and the O*NET interest items, and specific free-use licences for others — and each test page names the instrument, its authors and its licence. Where a licence forbids commercial use, we do not sell a report for that instrument.
If you believe something here infringes your rights, write to [EMAIL — contact address] with enough detail to identify the material and we will act promptly.
The site is provided as it is, when it is. We do not guarantee uptime, and we may change, suspend, or withdraw any test, feature or the whole site at any time, including the sale of reports. Because your results live in your browser rather than with us, a change on our side does not delete them — but a test that is withdrawn may no longer be able to render an old result.
To the fullest extent permitted by law, the site and everything on it are provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive loss, nor for loss of profit, revenue, data, goodwill or opportunity, arising out of or connected with your use of the site — including any decision you or anyone else takes on the basis of a result.
Our total aggregate liability arising out of or connected with the site, on any basis, is limited to the greater of the amount you actually paid us in the twelve months before the event giving rise to the claim, or $19.
What is not excluded
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, your mandatory statutory rights are unaffected, and where local law gives you more protection than this clause, that law applies.
If you use the site in breach of clause 5 or clause 6 — for instance by using a result in a hiring decision, or by republishing our content — you will indemnify us against claims, damages and reasonable legal costs arising from that use. This clause does not apply to consumers acting outside their trade or profession, to the extent local law does not permit it.
These terms are governed by the law of [COUNTRY], and the courts of [FORUM — competent courts] have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live, and you may bring proceedings in your own courts.
Consumers in the EU may also use the European Commission's online dispute resolution platform. We would rather hear from you first: write to [EMAIL — contact address] and we will try to settle it.
We may update these terms. The date at the top changes when we do, and the version published here is the one in force. Material changes will be flagged on the site. Continuing to use the site after a change means you accept the updated terms; a change cannot alter the terms that applied to a purchase you already made.
If any clause is held unenforceable, the rest stands and the offending clause is read down to the narrowest form that is enforceable. Our not enforcing a term on one occasion does not waive it. These terms, together with the Privacy Policy, are the whole agreement between us about the site.
